CRIMINAL PRESECUTION

Recent Cases:

  • ACAG investigators had been investigating Josephine since 2007. In 2014, a report was prepared and sent to NSW Police. In August 2014, we assisted NSW Police on a raid at her shop and residence. A total of 404 items were seized. Josephine plead guilty to 2 counts of sell, possess, import and expose goods with a falsely applied trade mark. She was fined $5,000 per count/office for a total of $10,000. The goods were destroyed.
  • ACAG investigators had been investigating CHOI, a market trader since 2009. In 2014, a report was prepared and sent to NSW Fair Trading. In March 2014, we assisted NSW Police and Fair Trading on a raid at CHOI's market stall. A total of 1706 items were seized. CHOI plead guilty to 19 sequences. She was convicted on each offence and received a $500 fine for each offence and $500 professional costs for a total of $10,000. The goods were destroyed.
  • In November 2013, we assisted NSW Police and the Department of Immigration and Citizenship execute a search warrant on a fashion shop. A total of 716 items were seized. The owner, KIM was fined $1,500 and the goods were ordered to be destroyed.
  • In August 2013, we assisted NSW Police execute a search warrant on a phone shop. A total of 931 phone accessories were seized. The owner, DAY plead guilty to 18 counts of Display for Sale and Possession of trade marked telephone covers. DAY received a fine of $1,800 and the goods were ordered to be destroyed.
  • In March 2013, we assisted NSW Police conduct a raid at 7 warehouses and a vehicle owned by an individual ZAYOUT, a major wholesaler in Sydney, NSW. The raid was after investigations conducted by ACAG investigators. A total of 25,773 items were seized across 30 brands. ZAYOUT was charged and sentenced with 8 months imprisonment fully suspended, to be of 8 months Good Behaviour and a $100 fine.
  • In August 2010, we assisted NSW Police raid a stall at Parklea Market. 223 counterfeit items were seized across 8 brands.
  • In July 2009, we reported to Police and assisted in the execution of search warrant which lead to the seizure of 214 items across 14 brands in the Fairfield district in NSW.
  • In October 2008, a man was sentenced to 12 months imprisonment for warehousing and selling over 5,000 garments and fashion accessories at Roselands in NSW.
  • In July 2008, a stallholder at Fairfield Market was charged after we investigated and complained. He was convicted on 3 counts and fined $5,000.
